This is something that doesn't have strict rules and would be evaluated case by case. At the end of the day, we do the same thing by browsing images and getting inspiration by other's work, so once the dust settles AI will prevail.Ībout copyright, AI art is not copyrightable, but the modifications on top of it are. Legally, the last thing I've read is you have a case suing when it's clear your work has been directly stolen (if something looks a lot like your piece), but that's not the case in virtually any the of cases (unless the AI model has been trained with your work directly).
